Basketball Australia has handed down its findings following an Integrity Unit investigation launched in response to a complaint by Crest Sports and Entertainment LLC, the owner of the Illawarra Hawks.

The independent review, led by Justin Gleeson SC, examined allegations relating to NBL owner and executive director Larry Kestelman, including claims of financial transparency issues and potential conflicts of interest.
The investigation found no credible evidence to support the claim, and no basis to establish a breach of any disciplinary or code of conduct provisions by Kestelman. It also concluded there was no evidence that the NBL or its clubs were disadvantaged by the conduct outlined in the complaint.
Basketball Australia Chair John Carey welcomed the thorough review.
“Mr Gleeson, who was eminently qualified to conduct this independent review, consulted closely with all NBL clubs and the league, and produced a rigorous and well-considered report,” Carey said.
“Basketball Australia appreciates the co-operation of the clubs throughout this process and will continue to work with the NBL to ensure the report’s recommendations are fully implemented.”
Mr Gleeson’s report has called for governance across Australian basketball to be lifted to international best practice, with Basketball Australia and the NBL now set to work together on a nine-month improvement project overseen by global risk and financial advisory consultant Kroll, aimed at strengthening standards and supporting continued growth of the game.
In a statement, Kestelman welcomed the outcome and said his focus remained on the league’s future following a record-breaking season.
“I’m pleased this matter is now behind us and that my name has been cleared,” he said.
“I have worked tirelessly over the past 15 years to rebuild and grow the NBL, always acting in the best interests of basketball in Australia, and I welcome the outcome of this investigation.
“I thank Basketball Australia, its integrity unit, and Mr Gleeson for handling the matter diligently and ensuring a fair and thorough process.
“I remain committed to the continued growth of the NBL and to working collaboratively across the sport. This presents a clear opportunity to further align and deliver world-class standards both on and off the court.
“We look forward to a united future and remain focused on delivering for fans, supporting our clubs, and driving continued growth.”
Separately, Crest Sports and Entertainment LLC has initiated proceedings in the NSW Supreme Court. The NBL was successful in the initial case, however an appeal has been lodged, with a decision expected in July.
