And that document that was withheld from my client. \u201cThe ECB had the right to maintain privilege over it for good reason,\u201d replies Botros.<\/p>\n<p class=\"dcr-1rmlzqn\">\u201cSurely you should have conducted an investigation and disclosed all documents, good and bad,\u201d says Stoner. \u201cWe did subject to legal principles.\u201d \u201cAnd four months after he was charged my client finally got them.\u201d \u201cIt was a significant amount of time before the hearing,\u201d says Botros.<\/p>\n<footer class=\"dcr-3i7iba\"\/><\/article>\n<article id=\"block-6401d2a88f083697fad1b6fa\" class=\"block dcr-2s4ysr\">\n<header class=\"dcr-88va8u\"\/>\n<p class=\"dcr-1rmlzqn\"><strong>Notable admission by Botros<\/strong>, who confesses he was unable to get contact details for some of players involved in the match where Vaughan is alleged to have uttered the remarks to get evidence.<\/p>\n<p class=\"dcr-1rmlzqn\">\u201cYou were speaking to some players. Did it occur to ask them if they had details of other players?\u201d asks an incredulous Stoner. \u201cThe main way we got players was through the Professional Cricketers Association.\u201d<\/p>\n<p class=\"dcr-1rmlzqn\">Is it right that because the PCA did not get consent from three players, you took no other steps to approach those players? \u201cYes.\u201d<\/p>\n<footer class=\"dcr-3i7iba\"\/><\/article>\n<article id=\"block-6401d0fe8f08cbddc14ace26\" class=\"block dcr-2s4ysr\">\n<header class=\"dcr-88va8u\"\/>\n<p class=\"dcr-1rmlzqn\"><strong>Stoner continues to question Botros.<\/strong> He directs his attention to a point in his witness statement in which he stated: \u201cIn its capacity as a regulator, the ECB must remain independent of action being taken by one of its member first class county clubs.\u201d<\/p>\n<p class=\"dcr-1rmlzqn\">\u201cThat\u2019s just not what happened, is it?\u201d Stoner suggests. Botros bluntly replies: \u201cIt is what happened.\u201d Botros, who continues to sound defensive, is then asked: Did you look at anyone\u2019s phones to consider whether there were any relevant messages? \u201cMessages?\u201d Messages relevant to <a href=\"https:\/\/www.theguardian.com\/sport\/michael-vaughan\" data-component=\"auto-linked-tag\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">Michael Vaughan<\/a>, replies Stoner. \u201cWe didn\u2019t require anyone to hand their phones to us.\u201d Did you ask in any event if you could look? \u201cWe asked for relevant documents from individuals. Did we ask for people to hand their phones physically over to us? No.\u201d<\/p>\n<footer class=\"dcr-3i7iba\"\/><\/article>\n<article id=\"block-6401ccbf8f083697fad1b6b8\" class=\"block dcr-2s4ysr\">\n<header class=\"dcr-88va8u\"\/>\n<p class=\"dcr-1rmlzqn\"><strong>Stoner is criticising the process of the ECB\u2019s enquiry and its scope<\/strong>. He reads out comments from Lord Patel, who ran <a href=\"https:\/\/www.theguardian.com\/sport\/yorkshire\" data-component=\"auto-linked-tag\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">Yorkshire<\/a> after the Azeem Rafiq allegations emerged, in an interview given to the Eastern Eye. In it Patel starts by saying: \u201cwhen the going got tough the ECB didn\u2019t back him\u201d.<\/p>\n<p class=\"dcr-1rmlzqn\">\u201cI was asked by the ECB to meet a set of criteria that most people would have winced at, would have thought there\u2019s no way we can deliver this, and I delivered it,\u201d Patel adds. \u201cI was asked by the ECB to work with them to create a framework and an environment where we would prove to the world that we want a non-racist institution, and I did all that. I was asked by the ECB to ensure some people who were there from the previous regime did not take part in that governance process, very clear about that.\u201d<\/p>\n<p class=\"dcr-1rmlzqn\">Stoner asks whether Patel is right that during the period of the investigation into Yorkshire the ECB asked him to do all those things. \u201cThat is what you have read out, so that is the case.\u201d<\/p>\n<p class=\"dcr-1rmlzqn\">Are you saying Lord Patel is not being truthful? \u201cI am not saying that was the case. I can\u2019t talk of the things that Lord Patel talks about.\u201d<\/p>\n<p class=\"dcr-1rmlzqn\">Stoner suggests the ECB were \u201cactively involved\u201d in the Yorkshire situation while the investigation was ongoing. However, Botros insists that Stoner is \u201cmistaking\u201d the ECB\u2019s regulatory function from its other roles.<\/p>\n<footer class=\"dcr-3i7iba\">\n<p><time datetime=\"2023-03-03T10:45:24.000Z\" title=\"Last updated Friday, 3 March 2023 at 10:45 Coordinated Universal Time\">Updated at 05.45\u00a0EST<\/time><\/p>\n<\/footer>\n<\/article>\n<article id=\"block-6401ca0d8f083697fad1b68f\" class=\"block dcr-2s4ysr\">\n<header class=\"dcr-88va8u\"\/>\n<p class=\"dcr-1rmlzqn\"><strong>Christopher Stoner KC, counsel for Vaughan, is questioning Botros\u2019s submission, saying it should have included points for and against the ECB\u2019s case rather than be one-sided.<\/strong> Stoner then asks \u201cwhat on earth is the purpose\u201d of Botros mentioning in his witness statement that Ajmal Shahzad \u201cnotably\u201d failed to mention that he had shaken Michael Vaughan\u2019s hand before the T20 match.<\/p>\n<p class=\"dcr-1rmlzqn\">Of course Shahzad was the <a href=\"https:\/\/www.theguardian.com\/sport\/yorkshire\" data-component=\"auto-linked-tag\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">Yorkshire<\/a> player who has said he never heard anything untoward said by Vaughan \u2013 and Stoner suggests that the ECB was trying to undermine Shahzad\u2019s evidence.<\/p>\n<p class=\"dcr-1rmlzqn\">\u201cNo \u2013 it\u2019s in there to set out relevant information in terms of what I can give for my witness statement,\u201d replies Botros. He disagrees with Stoner\u2019s line of questioning and insists the ECB\u2019s investigation was \u201cfair and proportionate\u201d.<\/p>\n<footer class=\"dcr-3i7iba\">\n<p><time datetime=\"2023-03-03T10:45:36.000Z\" title=\"Last updated Friday, 3 March 2023 at 10:45 Coordinated Universal Time\">Updated at 05.45\u00a0EST<\/time><\/p>\n<\/footer>\n<\/article>\n<article id=\"block-6401c8db8f0865098e4de6fb\" class=\"block dcr-2s4ysr\">\n<header class=\"dcr-88va8u\"\/>\n<p class=\"dcr-1rmlzqn\">We now move back to the ECB\u2019s case against <a href=\"https:\/\/www.theguardian.com\/sport\/michael-vaughan\" data-component=\"auto-linked-tag\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">Michael Vaughan<\/a>, who is<br \/>charged with the use of \u201cracist and\/or discriminatory language\u201d. He is alleged to have said \u201cthere\u2019s too many of you lot, we need to have a word about that\u201d towards the four Asian players before Yorkshire\u2019s Twenty20 match against Nottinghamshire on 22 June 2009. It is the only charge brought against Vaughan who denies the allegation.<\/p>\n<p class=\"dcr-1rmlzqn\"><strong>Meena Botros<\/strong>, the ECB\u2019s director of legal and integrity, takes the stand.
