Dani Alves<\/strong>, the 39-year-old footballer who has been in pre-trial detention without bail since January 20 on a rape accusation, will ask to be released on bail.<\/p>\n The alleged assault took place on December 30 at a nightclub in Barcelona.<\/p>\n The newspaper La Vanguardia reports that the lawyer Cristobal Martell <\/strong>will present an appeal to the Audiencia de Barcelona.<\/p>\n Mayka Navarro <\/strong>publishes that this appeal presents “guarantees to the magistrates that the Brazilian will remain at his home in Barcelona for the necessary time until the trial is held”.<\/p>\n Among these “guarantees” could be the use of a telematic bracelet, the surrender of his passport, signing in court every day or depositing a sum of money to cover any financial responsibility for the trial.<\/p>\n Alves<\/strong>, who is still being held in module 13 of Brians 2 prison in Sant Esteve Sesrovires, continues with his process of adaptation to the prison regime.<\/p>\n Sources consulted by the newspaper report “there is no favourable treatment or exceptional measures” with Alves <\/strong>in Brians 2.<\/p>\n According to their sources, Alves <\/strong>said in prison that: “I will accept whatever comes. I left home when I was only 15 years old. I have overcome very difficult and complicated situations in my life. This will be one more that will pass. I’m not afraid of anything”.<\/p>\n Alves <\/strong>insists whilst in prison that the sexual relations he had in the Sutton club, for which he is accused of rape, were “with the woman’s consent”.<\/p>\n Martell<\/strong>, Alves<\/strong>‘ lawyer, spoke on Antena 3 about the case. The reason for his contradictions in his statements, as the former Barcelona <\/strong>and Sevilla <\/strong>player told his new lawyer, was because he was “afraid of revealing in public that he had been unfaithful to his wife”.<\/p>\n According to the victim’s statement, which the investigating judge considers “forceful and persistent”, the player forced himself on her in a bathroom located in a reserved area of the Sutton nightclub in Barcelona on the night of December 30-31.<\/p>\n Following the latest legislative modification, the penalties range from four to 12 years in prison when the aggression consists of carnal access through the vagina, anus or mouth.<\/p>\n<\/div>\nDani Alves to his fellow prisoners: I will accept whatever comes.
